Email & Text Message Marketing Policy
Jpetrous Creative Services LLC (“JpCS”)
Last Updated: October 29, 2026
Who owns the list, who is responsible for consent, and the rules we will not bend on email and text message campaigns. This policy supplements the Terms and Conditions and the Privacy Policy.
This policy applies wherever JpCS builds, sends, schedules, or manages email or text message marketing on your behalf, including newsletters, promotional campaigns, automated sequences, and transactional messages we help configure.
Your subscriber list, contact records, and engagement history belong to you. They live in a platform account in your name, as described in the Client Access & Credentials Policy. We can export the list to you at any time, on request, without conditions.
We do not use your list for our own marketing, we do not merge it with another client’s, and we do not take it with us when an engagement ends.
Every contact we send to must have agreed to hear from you. When you supply a list, or ask us to add contacts, you are confirming that each person on it gave permission, and that you can show when and how if you are ever asked.
We are not able to verify consent for contacts we did not collect, and we rely on your confirmation. If you are unsure whether a list was properly collected, tell us before the first send rather than after.
We will not send marketing to a purchased, rented, scraped, or harvested list, to addresses collected for an unrelated purpose, or to contacts from a business you acquired without checking what they agreed to. This is not negotiable, and it is not a judgment about you — it is the fastest way to get a sending domain blacklisted and an account shut down, and the damage lands on your business, not ours.
Business cards collected at an event, contacts who filled in a form, and customers who opted in during checkout are fine. A spreadsheet someone sold you is not.
Campaigns we send are built to comply with the CAN-SPAM Act:
Text messaging is governed by the Telephone Consumer Protection Act, and the rules are considerably stricter than email. Where we run text campaigns:
We would rather explain this once than have it come up later. The Telephone Consumer Protection Act carries statutory damages of $500 to $1,500 per message, and claims are routinely brought as class actions. A single improperly consented send to a few thousand numbers is a business-ending event.
That exposure sits with you as the advertiser, not with the agency that pressed send. We will not run a campaign we believe puts you there, even at your request, and we will tell you why rather than quietly declining.
We build campaigns to arrive: authenticated sending domains, clean list hygiene, sensible send volumes, and content written to avoid the obvious filter triggers.
We cannot guarantee inbox placement. Mailbox providers decide what reaches an inbox using criteria they do not publish, weighted heavily by your own sender reputation and your recipients’ behavior. Open rates are an estimate, not a measurement, and have become less reliable as providers pre-fetch images on recipients’ behalf. We will tell you which numbers we would actually trust.
You are responsible for the truth of claims made about your business, products, pricing, and results. We will write to what you tell us and flag anything likely to draw a complaint or a regulator’s attention, but we are not in a position to verify it.
Some categories carry additional rules — health, finance and credit, housing, employment, alcohol, cannabis, gambling, and political messaging among them. If your campaigns touch one of these, raise it at the quoting stage.
Once someone opts out, they stay out. Suppression lists are honored across every campaign we run for you, and we will not remove someone from suppression so they can be contacted again, including by request.
When an engagement ends, the list, the templates, the automation sequences, and the sending history stay in your account. We remove our access as described in the Client Access & Credentials Policy. Nothing is held back and nothing is taken.
We may update this policy from time to time. Changes are effective when posted, indicated by the “Last Updated” date above. Material changes affecting an active engagement will be communicated directly.
